1. Agreement and provider
These terms form an agreement between you and Manifesting Magic Holdings LLC, doing business as CTX Food Trucks (“CTX,” “we,” “us,” or “our”). By using the site, submitting an application, or purchasing a service, you agree to these terms and our Privacy Policy. If you act for a business, you represent that you have authority to bind it.
2. What CTX provides
CTX provides local discovery services and advertising profiles for independent food trucks and other eligible food businesses. Optional services may include profile setup and managed profile updates. Applications are reviewed before an applicant receives a private Stripe payment link.
CTX is not the seller of food listed in the directory. We do not process customers’ food orders, take a commission on food sales, prepare or deliver food, or control a listed business’s permits, pricing, fulfillment, safety practices, or customer refunds.
3. Eligibility and business responsibilities
You must provide accurate, current information and have the rights and permissions needed to use all names, photos, logos, menus, links, and other materials you submit. Listed businesses remain solely responsible for applicable licenses, permits, food-safety rules, labeling, taxes, order fulfillment, customer service, and compliance with law.
We may reject an application or remove, suspend, or request correction of content that is inaccurate, misleading, unlawful, unsafe, infringing, abusive, or outside the service’s intended scope.
4. Prices, billing, and renewal
Current launch pricing is $49 per year for a Local Food Maker advertising profile. A qualifying first-time customer who uses the limited founding offer may pay $39 for the first year, followed by $49 per year at renewal. Optional Concierge Setup is a $49 one-time service. Optional Managed Updates is a $15 monthly subscription. The checkout page shows the amount, interval, discount, and taxes, if any, before payment.
Recurring services automatically renew using the payment method on file until canceled. You authorize Stripe to process the disclosed charges. We may change prices prospectively by providing reasonable notice; a price change does not alter an already-paid service period.
5. Cancellation and refunds
You can cancel future renewals through the Stripe billing portalor by contacting us before the next renewal. Cancellation generally takes effect at the end of the current paid period. Our Refund and Cancellation Policy contains the complete terms for refunds, duplicate charges, and services that have already begun.
6. Content permission
You keep ownership of materials you submit. You grant CTX a nonexclusive, worldwide, royalty-free license to host, reproduce, format, display, distribute, and promote those materials as reasonably needed to provide and market your profile and the CTX directory. This permission ends when the content is removed, except for reasonable backups, legal records, and previously published promotional copies.
7. Fair placement and service availability
Payment buys the disclosed advertising service, not a guaranteed rank, endorsement, lead, sale, revenue result, search-engine position, or customer response. We may organize and update the directory using relevance, location, completeness, freshness, user experience, and other reasonable factors.
We work to keep the service available and accurate, but online services can be interrupted or contain errors. To the fullest extent permitted by law, the service is provided without guarantees beyond those expressly stated in these terms. Nothing here limits a right or remedy that cannot lawfully be waived.
8. Limits and disputes
To the fullest extent permitted by law, CTX will not be liable for indirect, incidental, special, consequential, exemplary, or lost-profit damages arising from the service or an independent seller. CTX’s aggregate liability for a paid service will not exceed the amount you paid CTX for that service during the 12 months before the event giving rise to the claim. These limits do not apply where the law prohibits them.
Texas law governs these terms, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally may be brought in a court of competent jurisdiction in Texas. Before filing, please email us and allow a reasonable opportunity to resolve the issue.
9. Changes and contact
